the latches arent broken but the right one is out farther than the left one with gun completely dissambled this was before i found the staking a problem i talked to a gunsmith on the phone he said the foreend tube assy could have a problem whith the cams and shell latchs.he reccommened replacing both. as to the spring and follower he said not to much of a factor.

It would help if I could get a clear idea of orientation in your descriptions. You say "farther out"; out in which direction? Do you mean back (meaning toward the gun's butt-end in a direction parallel to the barrel axis) from the mouth of the magazine? The tip of one shell latch is supposed to be farther back than the other; if you can get your front trigger pin in, then your shell latches are in the correct position in that direction.

right side is looking down barel like shooting. the right latch is facing more to the left while holding the shell in about a heavy 1/8"

I'll check mine tonight to see how far the right side sticks out. It may be bent or deformed so it is grabbing to much. That might explain the issue.

If I'm understanding you correctly, it does sound like your right shell latch is the problem.
As you bring the slide forward, finishing the action cycle, an angled bit on the bottom of the right action bar contacts a tab on top of the right shell latch, pressing the latch's tip into a slot in the wall of the receiver. This releases the next shell in the magazine, allowing it to slip back and be held by the left shell latch while the gun's action is closed. The next time you bring the slide back, the right action bar releases the right shell latch, and then the left action bar retracts the left shell latch. The left latch releases the next shell onto the shell carrier to be chambered, the shell behind that slides back until it's caught by the right latch, and the cycle repeats as the action is closed again.
If, as you seem to be describing, the end of the right shell latch is bent so that it is a fraction of an inch farther away from the receiver wall than it should be; the right action bar will slide behind the latch's tab without making contact, and the right latch will not retract when the action closes. Because of this, the next shell in the magazine will continue to be held by the right latch instead being released onto the left latch, and the next time you rack the slide back, the left latch cannot release the shell.
If this is indeed the case (and nothing else is going on), replacing the right shell latch (or both latches, if you want) should fix the problem. I'm pretty sure you can just drop them in and run them without paying a gunsmith to stake them, as long as you don't mind a little extra hassle during take-down and reassembly.
You can order new latches directly through Remington's customer service line (I don't recommend using 3rd-party sellers for these kinds of parts). In the US, the number is 1-800-243-9700; M-F 9 AM - 5 PM Eastern time. 12ga shell latches are $13 each for the standard latches, $9 each for the Marine Magnum latches (no idea why the MM parts are cheaper). I can give you part numbers if you need them, but they should be able to look the correct parts up for you.

I looked at mine to compare and the latch is nowhere near 1/8th of an inch on the shell. Maybe just a hair further than a rim of the shell. Sounds like that is the problem.

After you close the action if the port side latch (right side) is still holding the shell then its bent. That side moves away when the action is closed. The left side should be holding the shell by itself. Then as you open the action the left side latch then releases the shell. If the port side latch is still holding it then it wont eject a shell from the mag tube.
